BABA, Plainly:
What changed in 2025
The Build America, Buy America Act is part of the Bipartisan Infrastructure Law. It requires infrastructure projects that receive federal funding to use materials produced in the United States. On January 14, 2025, the Federal Highway Administration rescinded the Manufactured Products General Waiver, which had been in place since 1983. That changed what “Made in the USA” means for federal-aid projects.
To count as “produced in the United States,” a manufactured product must:
- Be assembled in the United States. This applies to federal-aid projects obligated on or after October 1, 2025.
- Have more than 55% of its components, by cost, mined, produced or manufactured in the United States. This applies to federal-aid projects obligated on or after October 1, 2026.
Nextech works with manufacturing partners who meet both requirements today. Each partner below has given us a certification of BABA compliance for the products we carry, so you can specify with confidence on your next federally funded project.
